El uso cada vez más frecuente de la Inteligencia Artificial en el ámbito delDerecho, obliga a plantearse si las decisiones automatizadas pueden, y deben, ser justas. El algoritmo, en el Machine Learning, tiene la virtualidad de ir aprendiendo, lo que lo dota de un cierto grado de autonomía. Sesgos, discriminaciones y desigualdades que derivan de decisiones automatizadas, ponen al descubierto el mito del algoritmo justo. El criterio de justicia que se exige en la concepción analógica del Derecho también debe exigirse (...) en la dimensión digital. En este trabajo, desde la dificultad inicial de una falta de consenso sobre qué sea la fairness, examino cómo incorporar la fairness al algoritmo. Ello exigirá un previo análisis de los fundamentos iusfilosóficos y de algunas de las teorías de la justicia (utilitaristas, contractualistas, comunitaristas, igualitaristas) a partir de las cuales se puedan establecer parámetros, correctores y garantías para la consecución de la imprescindible correlación entre la fairness artificial y la fairness legal. La influencia perniciosa que el populismo tiene sobre numerosas construcciones, tiene a extenderse también al cosmopolitismo. En el terreno fértil de posmodernidad relativista y de narrativas contrahegemónicas, hay que deshacer dicotomías artificialmente construidas y fácilmente manipulables. En este trabajo se justificará por qué el populismo es una amenaza para la construcción cosmopolita y se reflejarán los aspectos que separan al populismo del proyecto cosmopolita. A partir de uno de los subtipos del populismo, el punitivo, se examinará la problemática que suscita (...) su aplicación a dos de las vertientes del identitarismo como son las cuestiones relativas al género (sexo) y a la idiosincrasia nacional (frente a “los otros”). El presente trabajo se propone recuperar las nociones de biopolítica y debiopoder en cuanto origen y fundamento de los actuales constructos de lapsicopolítica y del psicopoder. El tiempo pandémico, que obligó a recuperarlos postulados de la sociedad disciplinaria, contribuyó a expandir el universodigital y tecnológico, configurando unos poderosos instrumentos que yano solo se sirven del control sobre el cuerpo sino también –y principalmente–de la mente. Los efectos de este psicopoder smart se dejan notar en losindividuos, configurando una situación de servidumbre (...) voluntaria y prereflexivaen la mayor parte de los casos. La búsqueda de soluciones para superartal estadio de servidumbre es uno de los grandes retos que, en la sociedadtecnológica, tiene el jurista en general, y el filósofo del Derecho enparticular, intentando aunar racionalidad y ética. En décadas pasadas América Latina ha atravesado un ciclo autoritario en su trayectoria pendular entre democracia y dictadura. Actualmente se trata de que la sociedad política busque solución a los problemas en fórmulas diversas del recurso al brazo armado del Estado. En este trabajo hemos querido poner de manifiesto las dificultades de las democracias latinoamericanas "formales" o "impuestas" poniendo de relieve las dificultades y dilemas a los que han de enfrentarse, no tanto para instaurar cuanto para consolidar sus democracias.

Cada vez son más estrechas las relaciones entre la informática y el Derecho. La evolución ha sido notable: de la informática jurídica documental, que nos ha facilitado en numerosas ocasiones obtener información jurídica muy completa en un corto espacio de tiempo, hemos pasado a una Informática jurídica de gestión, que cada día avanza más en su empeño de liberar al jurista de las tareas más rutinarias. Se ha llegado así a la Informática jurídica decisional, con un futuro más prometedor. Pero (...) también, como contrapartida, es la esfera que más susceptibilidades y reticencias provoca. Concretamente, vamos a prestar especial atención a la proyección de las nuevas tecnologías en las decisiones judiciales, tanto en la vertiente de la Inteligencia Artificial como en la de los Sistemas Expertos Jurídicos: es un área controvertida, ya que en la actualidad no es posible, ni deseable, una suplantación plena del razonamiento jurídico del juez o del abogado por el cálculo informático del ordenador. Basta que se configure como una herramienta de apoyo o de ayuda a la decisión. Todo ello proyecta una nueva línea de reflexión para la Filosofía del Derecho, como es la hermenéutica telemática. Un análisis de la situación actual del estado de salud mental de un alto número de la población global basta para dar cuenta de la gravedad del asunto y plantear diversas posibles soluciones. El transhumanismopropone mejorar al ser humano mediante innovación tecnológica. En este trabajo se explica cómo esa innovación pude mejorar el bienestar del ser humano, analizando las consecuencias éticas y sociales de la propuesta del superbienestar y discutiendo también las críticas al transhumanismo por parte de los bioconservadores.

Interest in republicanism as a political theory has burgeoned in recent years, but its implications for the understanding of law have remained largely unexplored. Legal Republicanism is the first book to offer a comprehensive, critical survey of the potential for creating republican accounts of fundamental issues in law and legal theory.

Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)

A discussion of Higginbotham's distinction between mastering and possessing a concept.

This study uses a Corpus Assisted Discourse Studies methodology to provide the first systematic analysis of how trust is discursively constructed in crypto-drug markets. The data come from two purpose-built corpora. One comprises all the forum messages posted on the flag ship crypto-drug market Silk Road during the years in which it traded on the hidden net. The other corpus comprises all the reports published by the United Nations Office on Drugs and Crime during the same period. Our analysis of (...) trust focuses on the identities of those buying and selling drugs. The findings reveal that the Silk Road community members regularly discussed vendors’ identities alongside a continuum of trust–risk calculation, explicitly identifying both ‘good’ and ‘bad’ practices and hence engaging in self-regulatory discourses, and mainly constructed drug users’ identities in relation to values of expertise, integrity and benevolence. The findings also suggest that hard law enforcement activity, such as crypto-drug market closure, may encourage technological innovation within these markets. Moreover, our results show a disconnect between the discursive reality of the policy-making documents we examined and the very crypto-drug markets that they seek to legislate. (shrink)

In recent years, several countries have enacted guidelines and/or mandatory laws to increase the presence of women on the boards of companies. Through these regulatory interventions, the aim is to eradicate the social and labor grievances that women have traditionally experienced and which has relegated them to smaller-scale jobs. Nevertheless, and despite the advances achieved, the female representation in the boardroom remains far from the desired levels. In this context, it is now necessary to enhance the advantages of board gender (...) diversity from both ethical and economic points of view. This article examines the relation between board gender diversity and economic results in Spain: the second country in the world to legally require gender quotas in boardrooms and historically characterized by a minimal female participation in the workforce. Based on a sample of 125 non-financial firms listed on the Madrid Stock Exchange from 2005 to 2009, our findings show that in the period analyzed the increase of the number of women on boards was over 98 %. This suggests that compulsory legislation offers an efficient framework to execute the recommendation of Spanish codes of good governance by means of the increase in the number of women in the boards of firms. Furthermore, we find that the increase in the number of women on the boards is positively related to higher economic results. Therefore, both results suggest that gender diversity in boardrooms should be incremented, mandatory laws being a key factor to do so. (shrink)

Since then, we have become used to the idea that there is a hierarchy in medical evidence. The COVID-19 pandemic has impacted medical care in many ways; previously, a patient would enter a hospital and had an approximate idea of what would happen upon his admission, the physician informed them about it, but in the last two years this scenario has changed. Therefore, our aim was to identify if bioethical principles are present in the physician–patient relationship and the effect of these in the health care provided, through an observational and descriptive study where patients answered the validated (...) ReMePaB questionnaire that measures the presence of bioethical principles in the physician–patient relationship, on the seventh day of their hospital stay and 24 h after discharge, during the period from 1 August to 5 November 2020. In autonomy, an improvement in the score was observed in the second application compared to the first measurement; in the principle of non-vulnerability, the same scenario was observed for the first and second measurements, respectively. In the principles of beneficence, dignity, and justice, no statistically significant differences were observed. Considering the presence or absence of bioethical aspects in health care in this pandemic creates an area of opportunity to know the feelings of the patient during the care received and to maintain what is done well and improve those aspects that can be improved. Background:Ambulance professionals often address conflicts between ethical values. As individuals’ values represent basic convictions of what is right or good and motivate behaviour, research is needed to understand their value profiles.Objectives:To translate and adapt the Managerial Values Profile to Spanish and Swedish, and measure the presence of utilitarianism, moral rights and/or social justice in ambulance professionals’ value profiles in Spain and Sweden.Methods:The instrument was translated and culturally adapted. A content validity index was calculated. Pilot tests were carried out with 46 (...) participants.Ethical considerations:This study conforms to the ethical principles for research involving human subjects and adheres to national laws and regulations concerning informed consent and confidentiality.Findings:Spanish professionals favoured justice and Swedish professionals’ rights in their ambulance organizations. Both countries favoured utilitarianism least. Gender differences across countries showed that males favoured rights. Spanish female professionals favoured justice most strongly of all.Discussion:Swedes favour rights while Spaniards favour justice. Both contexts scored low on utilitarianism focusing on total population effect, preferring the opposite, individualized approach of the rights and justice perspectives. Organizational investment in a utilitarian perspective might jeopardize ambulance professionals’ moral right to make individual assessments based on the needs of the patient at hand. Utilitarianism and a caring ethos appear as stark opposites. However, a caring ethos in its turn might well involve unreasonable demands on the individual carer’s professional role. Since both the justice and rights perspectives portrayed in the survey mainly concern relationship to the organization and peers within the organization, this relationship might at worst be given priority over the equal treatment and moral rights of the patient.Conclusion:A balanced view on ethical perspectives is needed to make professionals observant and ready to act optimally – especially if these perspectives are used in patient care. Research is needed to clarify how justice and rights are prioritized by ambulance services and whether or not these organization-related values are also implemented in patient care. (shrink)

I-BLOCKS are an innovative concept of building blocks allowing users to manipulate conceptual structures and compose atomic actions while building physical constructions. They represent an example of enabling technologies for tangible interfaces since they emphasise physicality of interaction through the use of spatial and kinaesthetic knowledge. The technology presented in this paper is integrated in physical building blocks augmented with embedded and invisible microprocessors. Connectivity and behaviour of such structures are defined by the physical connectivity between the blocks. These are (...) general purpose, constructive, tangible user interface devices that can have a variety of applications. Unlike other approaches, I-BLOCKS do not only specify a computation that is performed by the target system but perform at the same time the computation and the associated action/functionality. Manipulating I-BLOCKS do not only mean constructing physical or conceptual structures but also composing atomic actions into complex behaviours. To illustrate this concept, the paper presents different scenarios in which the technology has been applied: storytelling performed through the construction of physical characters exhibiting emotional states, and learning activities for speech therapy in cases of dyslexia and aphasia. The scenarios are presented; discussing both the features of the technology used and the related interaction design issues. The paper concludes by reporting about informal trials that have been conducted with children. It should be noted that, even if both trials represent application scenarios for children, the I-BLOCKS technology is in principle open to different kinds of applications and target users like, for example, games for adults or brainstorming activities. Se presenta una propuesta de innovación educativa, dirigida al alumnado de Educación Secundaria, fundamentada en el uso de los itinerarios didácticos teatralizados como recurso didáctico con perspectiva de género. Para su confección se pretende una metodología que privilegia los contenidos procedimentales y que fomenta el pensamiento histórico y, por ende, el pensamiento crítico. Los contenidos seleccionados están relacionados con el siglo XVI y XVII y, más concretamente, con la persecución y procesamiento de mujeres por brujería y hechicería por parte del (...) Tribunal de la Inquisición. Para ello se toma como centro de estudio el proceso que se llevó a cabo en Córdoba contra Leonor Rodríguez, lo que llevará al alumnado a reflexionar y a preguntarse sobre los estereotipos de la mujer en la historia, así como en la actualidad, con la intención de formar a una ciudadanía crítica y comprometida. A la hora de plantearse la realización de actividades relacionadas con la enseñanza de los aspectos astronómicos, se presentan problemas prácticos evidentes que no ayudan a desarrollar una adecuada actividad científica escolar. Las TIC son un instrumento de gran utilidad para sortear estas dificultades, dado que permiten reproducir los fenómenos celestes y experimentar con ellos. El objetivo de este artículo es, en concreto, reflexionar sobre la utilidad de las simulaciones informáticas para la enseñanza de los aspectos histórico-astronómicos. This volume offers novel and provocative insights into vulnerability and exclusion, two concepts crucial for the understanding of contemporary political agency. In twelve critical essays, the contributors explore the dense theoretical content, complex histories and conceptual intersection of vulnerability and exclusion. A rich array of topics are covered as the volume searches for the ways that vulnerable and excluded groups relate to each other, where the boundary between the excluded and the included arises, and what the stakes of ‘invulnerability’ might (...) be. Background The COVID-19 pandemic has influenced the approach to the health-disease system, raising the question about the principles of bioethics present in physician–patient relations. The principles while widely accepted may not be sufficient for a comprehensive ethical analysis. Therefore, the aim of this study was to explore the perception of these principles and the physician–patient relationship during a hospital stay through a qualitative approach. Method Sixteen semi-structured interviews took place to know the patients’ perception during their 2020 hospitalization for COVID-19. (...) The data was analyzed through the constant comparison method, creating categories and comparing them. In the end, seven categories were established and were grouped in three: bioethical principles (dignity, charity, vulnerability, autonomy), doctor-patient relationship (participant commitment, informed consent, health staff-patient relationship) and the experience of the disease (illness, the role of the family). Results The research found that most patients described a positive experience, with the feeling of having been well cared for with no sense of discrimination or injustice done. The majority also reported that their autonomy was respected in the treatment decisions. The evaluation of these attitudes is an area of opportunity, especially when the patients' vulnerability is at risk. Conclusions The ethics of virtue offers a better reflection of how human beings manifest themselves by emphasizing the development of virtuous character and behaviors that allow them to realize their values in life. We describe an exploratory case study about the applicability of different robotic platforms in an educational context with a child with Down syndrome. The robotic platforms tested are the humanoid robot KASPAR and the mobile robotic platform IROMEC. During the study we observed the effects KASPAR and IROMEC had in helping the child with the development and improvement of her social skills while playing different interactive games with the robots. Conceptually similar play scenarios were performed with both robots and the (...) behaviour of the child was monitored during her interactions with them. (shrink)
